Welcome to Clarity Journal. By accessing or using our mental health journaling application ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

These terms govern your access to and use of the application. If you purchase a subscription, you will also be subject to the separate terms of our Merchant of Record, Paddle.com, which govern the sale, billing, and subscription management.

If you do not agree with any of these terms, you are prohibited from using or accessing this service.

User Accounts

Account Creation

To use Clarity Journal, you must create an account. When creating an account, you agree to:

  • Provide accurate information
  • Maintain the security of your password
  • Be at least 13 years of age
  • Accept responsibility for all activities under your account

Account Termination

You may delete your account at any time through the Settings page. We reserve the right to suspend or terminate accounts that violate these Terms of Service.

User Content and Conduct

Your Content

You retain all ownership rights to the content you create in Clarity Journal. By using our service, you grant us a limited license to:

  • Store and display your content to you
  • Process it (with your consent) to provide AI features, insights, and analytics

We will never share your personal journal entries with other users or use them for marketing purposes.

Prohibited Conduct

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access
  • Upload malware
  • Reverse engineer the service
  • Resell the service

AI Features and Third-Party Services

When you use our AI-powered features, you understand that:

  • Your journal entries (with PII automatically anonymized) are sent to OpenAI for processing.
  • AI-generated insights are provided "as is" and may occasionally be inaccurate.
  • AI insights are not professional mental health advice.

Intellectual Property

The Clarity Journal service is owned and operated by Sole Proprietor Yaroslav Mykolaiovych Chmyr, based in Ukraine.

The Clarity Journal service, including its original content, features, and functionality (excluding your personal content), is owned by Clarity Journal and protected by intellectual property laws.

Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Clarity Journal shall not be liable for any indirect, incidental, special, or consequential damages, or loss of data arising out of your use of the service.

Data Loss

While we implement robust security measures, we recommend regularly exporting your data. We are not responsible for any data loss.

Subscription and Payment Terms

All subscriptions to Clarity Journal are sold and managed by our third-party reseller and Merchant of Record, Paddle.com.

Billing

By purchasing a subscription, you are entering into an agreement directly with Paddle. All billing, payments, and subscription management are handled by Paddle through the Paddle Checkout. You will be subject to Paddle's Buyer Terms, which will be presented to you at the time of purchase.

Cancellations

You can manage or cancel your subscription at any time through the Paddle subscription management portal (a link will be provided to you after purchase).

Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms of Service.

Modifications to Service and Terms

We reserve the right to modify the service or update these Terms of Service at any time. We will notify you of significant changes. Continued use of the service after such modifications constitutes acceptance of the updated terms.

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Clarity Journal operates.

Any disputes arising from these terms or your use of the service itself (such as issues with app functionality, your content, or AI features) shall be resolved through binding arbitration.

This does not apply to billing disputes. Any disputes related to subscription payments, charges, or refunds are governed by the terms of our reseller, Paddle.com, and must be resolved directly with Paddle.

Indemnification

You agree to indemnify and hold harmless Clarity Journal from any claims, damages, or expenses arising from your use of the service or your violation of these Terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Clarity Journal regarding the use of our application and service.

The purchase, billing, and subscription management for our service are governed by the separate Buyer Terms of our reseller, Paddle.com, which you agree to when you make a purchase.
